That [1]

That (lat. Facinus), eine von einem Erfolge begleitete innere od. äußere Thätigkeit, als deren Ursache Überlegung u. Wille gedacht wird; den unbewußten Naturkräften schreibt man Thätigkeiten, aber keine T-en zu. Vermöge ihrer Abhängigkeit vom Denken u. Wollen, also als bewußte u. gewollte, unterliegt sie einer sittlichen u. rechtlichen Beurtheilung, sie ist gut od. bös, edel od. schändlich, unschuldig od. strafbar. Da aber die Abhängigkeit der T. von der Überlegung u. dem Wollen u. des äußeren Erfolges von der inneren T. (dem Entschluß) Grade hat u. mannigfachen Modificationen unterliegt, so ist die sittliche od. rechtliche Zurechnung der T. häufig Gegenstand einer besonderen Untersuchung (s. Verbrechen, Zurechnung). Der Unterschied des älteren Deutschen Rechts zwischen handhafter od. nicht übernachteter, u. nicht handhafter od. übernachteter T. bezieht sich darauf, ob der Verbrecher auf frischer T. ertappt wird od. ob bis zur Entdeckung des Verbrechens schon 24 Stunden verflossen sind. Die Größe menschlicher T-en findet ihr Maß theils in der dazu nöthigen inneren u. äußeren Kraftanstrengung, theils in dem [443] Umfange u. der Wichtigkeit ihrer Erfolge u. Wirkungen.
